Welcome to Market My Mobile. These Terms of Service ("Terms") govern your access to and use of the Market My Mobile platform, website, and services (collectively, the "Service"), operated by Market My Mobile, a South Carolina S-Corporation ("Company," "we," "us," or "our"). By creating an account or using our Service, you agree to be bound by these Terms.
1. The Service
Market My Mobile connects local businesses ("Advertisers") with vehicle owners ("Drivers") for the purpose of displaying advertising materials on Drivers' vehicles in the Grand Strand area of South Carolina. We facilitate the matching, contracting, and payment process between these parties.
2. Eligibility
All Users
- You must be at least 18 years of age to create an account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the security of your account credentials.
Drivers
In addition to the above, Drivers must meet all of the following requirements to participate:
- Be at least 25 years of age
- Hold a valid, unexpired driver's license
- Have no DUI, DWI, or reckless driving convictions in the past 7 years
- Have fewer than 2 minor traffic violations in the past 5 years
- Be the primary driver of the listed vehicle (80% or more of usage)
- Maintain active auto insurance meeting South Carolina minimum coverage requirements throughout the duration of any campaign
- Consent to a Motor Vehicle Record (MVR) background check prior to campaign activation
- Have a vehicle in good or excellent condition with no major visible damage
Important: Providing false information during registration or the eligibility attestation process may result in immediate account termination and may constitute fraud.
Advertisers (Businesses)
- Must be a legally operating business
- Must have authority to bind the business to these Terms
- Are responsible for ensuring all submitted ad content complies with our Content Policy (Section 6)
3. Driver Obligations
- Maintain the vehicle in the condition represented at time of approval throughout the campaign
- Keep the advertising material clean, undamaged, and properly displayed at all times
- Submit monthly odometer readings between the 20th and 25th of each month
- Submit installation photos when required
- Notify Market My Mobile immediately if your insurance lapses, your license is suspended, or your vehicle sustains significant damage
- Not remove or tamper with advertising materials before the campaign end date without written authorization
- Comply with all applicable laws and regulations while operating your vehicle
- For rideshare/delivery drivers: ensure compliance with your platform's policies regarding vehicle advertising
4. Advertiser Obligations
- Pay all campaign fees as agreed upon contract execution
- Provide accurate business information and ad content
- Submit only content that complies with our Content Policy
- Not contact Drivers directly outside of the Market My Mobile platform
- Maintain a minimum 3-month campaign commitment per contract
- Provide 30 days written notice to cancel after the minimum term
5. Payments and Fees
Advertisers
- Campaign fees are charged monthly on the 1st of each month
- A one-time installation fee of $175 applies to each campaign (paid to the installation shop)
- Multi-month discounts apply: 7% off for 6-month commitments, 10% off for 12-month commitments
- All fees are non-refundable except as required by law or stated otherwise in your contract
Drivers
- Driver payouts are processed on the 5th of each month for the prior month
- A one-time $25 MVR background check fee is required, refunded after your first successful campaign completion
- Earnings range from $100–$250/month based on vehicle tier, condition, and mileage
- Payments are subject to odometer verification
6. Content Policy
All advertising content submitted to Market My Mobile must comply with this policy. We reserve the right to reject any content at our sole discretion. Prohibited content includes but is not limited to:
- Profanity, offensive language, or adult/sexually suggestive content
- Alcohol, tobacco, cannabis, or vaping products
- Political campaigns, candidates, or endorsements
- Gambling, casinos, or betting services
- Weapons used to harm (lawful gun shops are permitted)
- Hate speech, discrimination, or content targeting protected groups
- Misleading, false, or deceptive claims
- Competitor attacks or negative comparative advertising
- Unauthorized pharmaceutical or medical claims
- Illegal products or services
Violation of this policy may result in immediate campaign termination without refund.
7. Intellectual Property
Advertisers retain ownership of their ad designs and creative materials. By submitting content, Advertisers grant Market My Mobile a limited license to reproduce, display, and distribute that content solely for the purpose of executing the campaign. Market My Mobile retains all rights to its platform, branding, and proprietary systems.
8. Limitation of Liability
To the maximum extent permitted by law, Market My Mobile shall not be liable for:
- Vehicle damage, accidents, or incidents occurring during a campaign
- Actions or omissions of Drivers or Advertisers
- Loss of income due to campaign suspension for policy violations
- Deactivation from rideshare/delivery platforms due to advertising display
- Any indirect, incidental, special, or consequential damages
Our total liability to any party shall not exceed the total fees paid to or by that party in the 3 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Market My Mobile, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
10. Termination
Market My Mobile reserves the right to suspend or terminate any account at any time for violation of these Terms, fraudulent activity, or conduct that we determine to be harmful to other users or the platform. Drivers may close their account at any time, subject to any active campaign obligations. Advertisers must fulfill their minimum campaign commitment before cancellation.
11. Dispute Resolution
These Terms are governed by the laws of the State of South Carolina. Any disputes arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Horry County, South Carolina, under the rules of the American Arbitration Association.
12. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email and post the updated Terms on our website with a new effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
